1. Acceptance of Terms
These Terms of Service ("Terms") govern all web scraping, data extraction, automation, and related consulting services provided by DataScraper ("we," "us," or "our") to our clients ("Client," "you," or "your").
By approving a quote, requesting a free sample, or engaging our data extraction services, you agree to be legally bound by these Terms. If you are entering into this agreement on behalf of a company or legal entity, you represent that you have the authority to bind such entity.
2. Ethical Web Scraping & Permissible Use
DataScraper adheres to strict ethical data extraction practices designed to balance our clients' data intelligence requirements with server integrity and privacy compliance:
- Public Data Only: We extract only publicly accessible web data (product pricing, catalog specifications, public business directories, real estate listings, and market data).
- No Unauthorized Authentication Bypass: We do not hack, breach security perimeters, or bypass login authentication to harvest confidential user data. If a project involves an authenticated portal, Client must provide legitimate, authorized access credentials.
- No Sensitive Personal Data (PII): We do not scrape, harvest, or aggregate sensitive personal financial data, medical records, or confidential individual identification without legal basis.
- Server Respect & Throttling: Our scraping pipelines utilize intelligent rate-limiting, randomized request delays, and distributed proxy networks to prevent overloading or disrupting target web servers.
- Client Responsibility: Client warrants that its intended use of the extracted data complies with all applicable local and international laws, including intellectual property and trade secret regulations.
3. Non-Disclosure & Data Confidentiality
We treat Client project specifications, target source lists, business models, and extracted datasets with strict professional confidentiality:
- Mutual NDA: We routinely execute mutual Non-Disclosure Agreements (NDAs) prior to project commencement upon request.
- No Data Reselling: DataScraper will never license, publish, resell, or distribute datasets custom-extracted for your project to competitors or third parties.
- Data Retention & Deletion: After final delivery and approval, we retain project delivery archives for 30 days solely for backup purposes, after which data can be permanently purged upon written request.
4. Service Level Agreement (SLA) & Maintenance
4.1 One-Time Delivery Projects
For one-time dataset deliveries, we provide a 7-day post-delivery warranty. If target website structures change within 7 days of delivery causing missing data, we patch the extractor and re-run at zero extra fee.
4.2 Recurring & Enterprise Pipelines
Websites inevitably alter their HTML layouts and anti-bot defenses over time. For clients on recurring monthly monitoring plans, our Service Level Agreement guarantees:
- Automated Health Checks: Daily pipeline monitoring flags broken selectors, failed schemas, or blocked requests automatically.
- 24–48 Hour Patch SLA: When a target site changes layout or deploys new anti-bot challenges (e.g. Cloudflare, DataDome), our dedicated engineers update and redeploy scrapers within 24 to 48 business hours.
- 99% Pipeline Uptime Target: We maintain high availability of automated data pipelines pushing directly to client S3, Google Cloud, PostgreSQL, or REST endpoints.
5. Data Completeness & Quality Guarantee
Every custom extraction project includes our 95%+ Data Completeness Standard:
- Pre-Payment Sample: We deliver a 50–100 record sample free of charge. Invoicing commences only after you have verified and approved the sample structure.
- Free Re-Runs: If delivered data deviates materially from agreed schema specifications or falls below agreed completeness thresholds, we re-scrape and clean the missing records without additional charges.
6. Pricing, Payments & Cancellation
- Upfront Quotes: All projects operate under fixed-price quotes or agreed monthly retainers. No hidden fees or unexpected proxy surcharges.
- Accepted Payment Rails: Domestic Indian clients can pay via UPI, NEFT/RTGS, and Razorpay. International clients pay via Wire Transfer, PayPal, or Wise in USD.
- No Lock-In Contracts: Monthly recurring pipelines operate on a month-to-month basis and can be canceled anytime with 7 calendar days' written notice prior to the next billing cycle.
7. Compliance with Applicable Laws
DataScraper operates out of Navi Mumbai, Maharashtra, India, and complies with applicable provisions of the Information Technology Act, 2000 (India) and Digital Personal Data Protection Act, 2023. Where international clients engage our services, we respect relevant extraterritorial data protection guidelines (including GDPR principles regarding minimization and CCPA regulations).
8. Limitation of Liability
DataScraper extracts data "as is" directly from designated third-party source websites. We do not warrant that source website content is accurate, up-to-date, or complete. In no event shall DataScraper's total aggregate liability arising out of or related to any project exceed the total fees paid by Client for the specific project during the two (2) months preceding the claim.
